1.4.4 Ethical, Environmental, Human Right, Fair working, Gender Equality Policy
Kyneton Biscuit Group Pty Ltd is committed to upholding and promoting human rights, fair working conditions, Gender Equality and environmental protection. In accordance with the expectations of our suppliers, customers, the community, and the requirements of the relevant Laws in Australia, we endeavour to always operate responsibly within the community. Kyneton Biscuit Group Pty Ltd is committed to maintaining a reputation for the highest legal, moral and ethical standards in our dealings with our suppliers, customers and other key stakeholders and believe that it is critical for our ongoing success.
We expect our management and employees to support the ethical standards set out in this Policy about workplace safety, environment, and fair pay and employment conditions. Kyneton Biscuit Group Pty Ltd is also committed and refer to UN Guiding Principles for Business and Human Rights
1. Bribery and Corruption:
• Employees of Kyneton Biscuit Group Pty Ltd shall not engage in acts of bribery and corruption and shall not falsify documents and records.
2. Labour Rights of Kyneton Biscuit Group Pty Ltd employees:
• Employment is freely chosen.
• There is no forced, bonded or involuntary prison labour.
• Employees are not required to lodge deposits or their identity papers with Kyneton Biscuit Group Pty Ltd and are free to leave after reasonable notice as prescribed in their employment contracts.
3. Freedom of association and the right to collective bargaining are respected:
• Employees, without distinction, have the right to join or form trade unions of their own choosing and to bargain collectively.
• Kyneton Biscuit Group Pty Ltd adopts an open attitude towards the activities of trade unions and their organisational activities.
• Employee representatives are not discriminated against and have access to carry out their representative functions in the workplace;
• Where the right to freedom of association and collective bargaining is restricted under Australian Law, Kyneton Biscuit Group Pty Ltd facilitates, and does not hinder, the development of parallel means for independent and free association and bargaining.
• Kyneton Biscuit Group Pty Ltd is committed to providing a safe and hygienic working environment, bearing in mind the prevailing knowledge of the industry and of any specific hazards. Adequate steps have been taken by Kyneton Biscuit Group Pty Ltd to prevent accidents and injury to health in the working environment;
• Employees shall receive regular and recorded health and safety training, and such training shall be repeated for new or reassigned employees;
• Kyneton Biscuit Group Pty Ltd provides clean toilet facilities, access to clean and drinkable water and sanitary facilities for food storage;
• Kyneton Biscuit Group Pty Ltd will ensure that personal protective equipment is available, and employees are trained in its use. Safeguards on machinery meet or exceed Australian Workplace Health and Safety Laws.
4. Child Labour:
• Kyneton Biscuit Group Pty Ltd do not employ any persons that are not legally permitted to be employed; There are no children or persons under the age of 16 working at Kyneton Biscuit
Group Pty Ltd.
5. Living Wages:
•All wages and benefits paid by Kyneton Biscuit Group Pty Ltd for a standard working week meet, at a minimum, national legal standards or industry benchmark standards, whichever is higher. Wages are enough to meet basic needs and to provide some discretionary income;
•All employees shall be provided with written and understandable information about their employment conditions in respect to wages before they enter employment and about the particulars of their wages for the pay period concerned each time that they are paid;
•Deductions from wages as a disciplinary measure or any deductions from wages not provided for by Australian Laws shall not occur without the expressed permission of the worker concerned. All disciplinary measures should be recorded.
6. Working Hours:
•Working hours comply with all Australian Laws and benchmark industry standards, whichever affords greater protection.
•Employees shall not on a regular basis be required to work more than 48 hours per week and shall be provided with at least one day off for every 7-day period on average.
•Overtime shall be voluntary, shall not be excessive, shall not be demanded on a regular basis and shall always be compensated at a premium rate.
7. Discrimination and Gender Equality:
•There is no discrimination in hiring, compensation, access to training, promotion, termination, or retirement based on race, caste, national origin, religion, age, disability, gender, marital status, sexual orientation, union membership or political affiliation.
•Kyneton Biscuit Group senior management following below standards to achieve gender equality at workplace.
•Senior management is responsible for the implementation, monitoring, and evaluation of measures that promote gender equality and women's empowerment at workplace based on below 5 standards.
•Commitment: We demonstrate an ongoing commitment to workplace gender equality and preventing other forms of gender-based violence.
•Conditions: We apply a gender lens to our workplace policies and practices to ensure they are fair and equitable.
•Culture: We promote a workplace culture where all staff feel safe, confident, and supported to actively challenge gender bias and discrimination, gender stereotypes and harmful gender norms without adverse consequences. Raises awareness on gender equality and women's empowerment with management and staff regularly.
•Support: We listen to, respect and support staff who experience sexual harassment and gender-based violence through policies and practices.
•Core business: We promote gender equality in our internal & external engagement with customers, stakeholders, and the staff.
• The standards can be used to identify areas of strength and opportunities for progress within organisation.
8. Harsh or Inhumane Treatment:
• Physical abuse or discipline, the threat of physical abuse, sexual or other harassment and verbal abuse or other forms of intimidation shall be prohibited.
9. Grievance Mechanism:
•Senior management have provided all staff to address any feedback or concerns /Complaints by communicating through emails or in person stated below in induction booklet.
•All feedback and concerns from staff will be discussed with senior management during management meetings regularly and handled by the Operational manager and managing director individually on a case-by-case basis.
•A grievance committee with decision making power, with knowledge about grievances, that is impartial, accessible, and gender sensitive.
•The grievance committee is formed by at least one member/worker representative.
•The grievance mechanism has appropriate submission channels, for internal and external stakeholders, including staff based on the organizational reporting structure.
•Anonymous grievances are accepted, and confidentiality is respected. Human and Labor rights grievances are remediated in accordance with the Remediation Protocol, and collaboration with the Assess-and-Address Committee and/or the Gender Committee/Person as appropriate, depending on the case. Anonymous feedback box available in lunchroom.
•(References: - United Nations Guiding Principles (UNGPs) on Business and Human Rights).
•Grievances and agreed follow-up actions are documented and shared with the people involved within a reasonable timeframe. Submitters of grievances are protected against employment/membership termination, retribution, or threats because of utilizing the grievance mechanism.
10. Kyneton Biscuit Group Pty Ltd Entitlement to Work and Immigration:
•Only employees with a legal right to work shall be employed.
11. Sub-Contracting and Home Working:
•Kyneton Biscuit Group Pty Ltd have adequate processes in place for properly managing subcontracting and home working to ensure sub-contractors do not abuse, exploit or provide unsafe working conditions for their employees.
12. Environment Compliance:
•Kyneton Biscuit Group Pty Ltd complies with national and local environmental laws and regulations.
•Kyneton Biscuit Group Pty Ltd disposes of its production waste in accordance with local environmental laws and regulations
•Kyneton Biscuit Group Pty Ltd have identified and documented its key environmental impacts and implemented controls to minimise its impact on the environment with respect to solid waste disposal, hazardous chemicals storage and management, air and water emissions.
The Managing Director, Management Team and all employees at Kyneton Biscuit Group Pty Ltd fully support this Policy and associated procedures and are committed to continuous improvement and reviewed at least annually.
